Are each equally negative? Is a flat out refusal the more helpful to a defense strategy? Most states have equal penalties for a refusal vs. a .08 or higher result. However, it’s my understanding that although the penalties may be the same, long term, you’ve not been technically convicted of a DUI charge. Instead you’re convicted of a refusal to submit to a chemical test. The refusal is a better choice when faced with the two. Any additional information regarding this would be appreciated. Thank you.

Clever conservators in our relatives' state aren't even allowing family members, including "conservator of the person" to see the finances at all, so they have no way of knowing where the money is going. But they do see the many "professional" overseers who are being paid handsomely. There is a GAL, two other attorneys, a conservator over the money, a trustee, and a case mgr who is an idiot with no medical background, but is constantly questioning and denying decision-making rights to the adult daughters who have been unpaid caregivers for 8 years, despite one of them having an extensive medical background. It's an absurd scenario in which a couple's daughters gave up their jobs and one sold her home in order to take care of their parents, but the court ended up appeasing and placating the ONE and ONLY addicted, alcoholic member of their immediate (and our extended) family who is an incessant whiner and narcissist. He claimed he was being denied rights to see his mother and father, though he has keys to their house and could go there any time. He apparently found out that is the biggest and best claim to make, and he knew the attorneys and judge wouldn't question it or hear recorded evidence of his actual visits. The guy SHOULD have been denied access because of his constant whining for money, but he wasn't. It was just a ploy to get control over his sisters in hopes of having them booted.
